1. scope of application
For the use of this website as well as the business relations between Alpinols.ch and its customers, the following General Terms and Conditions (GTC) apply in the current and valid version available when calling up the website or ordering goods. The offer on this website is aimed at customers resident in Switzerland.
The customer confirms that the purchase of the products is not intended for consumption or healing applications.
The term "customer" is used to refer to any natural person (of legal age or age of majority) or legal entity who has business relations with Alpinols.ch. The general terms and conditions, the terms of delivery and payment as well as the data protection regulations may be amended from time to time. Alpinols.ch asks you to read these conditions carefully each time you visit the website and each time you order goods.
These terms and conditions apply exclusively. Conflicting, supplementary or deviating conditions require the express written confirmation of Alpinols.ch to be valid. When using this website or placing an order for goods, the customer confirms that he fully accepts these General Terms and Conditions including delivery and payment conditions.
***The customer confirms that the purchase of the products is not intended for consumption or a therapeutic use***.
Should individual provisions of these GTC prove to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
The operator of this website is Swiss Organic Partners AG (see imprint).
2. information on this website
Alpinols.ch contains information about products. We reserve the right to make changes to prices, product ranges and technical specifications. All information on www.Alpinols.ch
(product descriptions, illustrations, films, dimensions, weights, technical specifications, accessory relationships and other information) are to be understood as approximate values only and do not represent any assurance of properties or guarantees, unless explicitly stated otherwise. Alpinols.ch endeavours to provide all information and data on this website in a correct, complete, up-to-date and clear manner, but Alpinols.ch cannot guarantee this either expressly or tacitly.
All offers on this website are non-binding and are not to be understood as a binding offer.
Alpinols.ch cannot guarantee that the products listed are available at the time of ordering. Therefore, all information on availability and delivery times are without guarantee and may change at any time and without notice.
The prices quoted by Alpinols.ch include statutory value-added tax. The prices are gross in Swiss francs (CHF). Unless otherwise specified, any shipping costs will be charged additionally and are to be paid by the customer. If shipping costs are incurred, they will be shown separately in the order process. Alpinols.ch reserves the right to make technical changes, errors and misprints, in particular to change prices at any time and without prior notice.
4. conclusion of contract
The offers on this website represent a non-binding invitation to the customer to order Alpinols.ch products. By placing an order via this website, including acceptance of these General Terms and Conditions, the customer submits a legally binding offer to conclude a contract. Alpinols.ch will then send an automatic "order confirmation" by email, confirming that the customer's offer has been received by Alpinols.ch. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.
The contract is concluded as soon as Alpinols.ch sends a declaration of acceptance by email confirming the dispatch of the ordered products or services.
Orders will only be delivered after complete receipt of payment (exception: delivery against invoice) and if the goods are available. If, after conclusion of the contract, the ordered goods cannot be delivered or cannot be delivered in full, Alpinols.ch is entitled to withdraw from the entire contract or from one part of the contract. If the customer's payment has already been received by Alpinols.ch, the payment will be refunded to the customer. If payment has not yet been made, the customer is released from the obligation to pay. Alpinols.ch is not obliged to make a replacement delivery in the event of termination of the contract.
5. payment options and retention of title
The customer has access to the payment options indicated in the order process. Alpinols.ch reserves the right to exclude customers from individual payment options without giving reasons or to insist on prepayment. Alpinols.ch can charge default interest of 9% per year and a maximum reminder fee of CHF 20.00 per reminder if the customer defaults on payment.
The products delivered to the customer remain the property of Alpinols.ch until full payment has been received.
6. delivery, inspection obligation, notification of defects and return shipment
Deliveries are made by post or courier to the address indicated by the customer in the order. The invoice will be sent by email, by post or included in the delivery. With the dispatch benefit and risk are transferred to the customer, as far as this is legally permissible.
If the delivery is not deliverable or if the customer refuses to accept the delivery, Alpinols.ch can dissolve the contract after notification of a complaint by email to the customer and setting a reasonable deadline and charge the costs for the activities.
The customer is obliged to examine the delivered goods immediately after receipt of the delivery and to immediately notify any defects for which Alpinols.ch warrants in writing by letter or email to the address in the (see imprint) notification.
Returns to Alpinols.ch are at the expense and risk of the customer. The customer must send the goods in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects to the return address specified by Alpinols.ch. If the inspection by Alpinols.ch reveals that the goods have no detectable defects or that these are not covered by the manufacturer's guarantee, Alpinols.ch may charge the customer for the activities involved, the return or any disposal.
7. right of withdrawal
The customer is granted a right of withdrawal for 14 calendar days after receipt of the goods. The deadline is considered met if the customer sends the written revocation by email (hello@Alpinols.ch) within the deadline. The revocation does not require any justification.
The exercise of the right of revocation leads to a reversal of the contract. The customer must return the goods to Alpinols.ch within 10 calendar days in their original packaging, complete with all accessories and together with the delivery note. Returns to Alpinols.ch are at the expense and risk of the customer. Any payment already made will be refunded to the customer within 20 calendar days if Alpinols.ch has already received the goods back or if the customer can provide proof of dispatch.
Alpinols.ch reserves the right to demand appropriate compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the reduction in value from the purchase price already paid or charge it to the customer.
In the following cases no right of revocation is granted:
(i) If the contract has a random element, namely because the price is subject to fluctuations over which the provider has no control.
(ii) If the contract relates to a movable item which, by its nature, is not suitable for return or is liable to deteriorate rapidly and/or consists of plant components.
(iii) If the subject matter of the contract is a movable item made to the consumer³s specifications or clearly tailored to his personal needs.
Alpinols.ch strives to deliver goods of impeccable quality. In the event of timely notification of defects, Alpinols.ch warrants the faultlessness and functionality of the item purchased by the customer during the statutory warranty period of two years from the date of delivery, as a rule. Alpinols.ch shall have the discretion to provide the warranty by free repair, equivalent replacement or reimbursement of the purchase price. Further claims are excluded.
The warranty does not cover normal wear and tear or the consequences of improper handling or damage by the customer or third parties or defects attributable to external circumstances. The warranty for herbal products or their components is also excluded.
Alpinols.ch it is not possible to give assurances or guarantees for the topicality, completeness and correctness of the data as well as for the constant or undisturbed availability of the website, its functionalities, integrated hyperlinks and further contents. Alpinols.ch excludes all liability, regardless of its legal basis, as well as claims for damages against Alpinols.ch and any auxiliary persons and vicarious agents. In particular, Alpinols.ch is not liable for indirect damages and consequential damages, loss of profit or other personal injury, property damage or pure financial losses of the customer. Further mandatory legal liability is reserved, for example for gross negligence or unlawful intent.
Alpinols.ch uses hyperlinks only for the simplified access of the customer to other web offers. Alpinols.ch can neither know the content of these websites in detail, nor assume any liability or other responsibility for the content of these websites.
10. data protection
Alpinols.ch may process and use the data collected within the framework of the conclusion of the contract for the fulfilment of the obligations arising from the purchase contract as well as for marketing purposes. The data required for the performance of the service may also be passed on to commissioned service partners (logistics partners) or other third parties involved in the conclusion of the sale.
The further data protection regulations can be viewed under the link visible on the homepage.
Alpinols.ch expressly reserves the right to amend these general terms and conditions at any time and to put them into effect without prior notice.
In the event of disputes, only substantive Swiss law shall apply, to the exclusion of conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.
The place of jurisdiction shall be Zurich, unless the law provides for mandatory places of jurisdiction.
